CANCELLATION POLICY

By submitting payment, client agrees to all terms in this legally binding contract with Jeremiah Briggs, DBA The Denver Balloon Guy™. Bookings are not guaranteed until full payment is received. A $50 non-refundable booking fee applies to all events, holds the date for up to 7 days or until another client requests the same time. Client will receive first right of refusal. Full payment is due in advance unless otherwise arranged. Events over 4 hours may incur processing fees unless paid by check. No post-dated or third-party checks accepted. Checks must clear before event. Cancellations must be in writing. Refunds follow this schedule: 14+ days out = $50 retained; 7–13 days = 25% due; 3–6 days = 50% due; under 72 hours = 100% due. Emergency cancellations may be refunded at artist’s discretion. If artist cancels, 100% refund will be issued, and help may be offered to reschedule or find a replacement. No refunds for weather. Client must provide indoor backup. Artist will not perform outside below freezing. Heaters can be added for a fee. Shade and water required in heat. Unsafe conditions (wind, lightning, smoke, etc.) may pause or cancel performance. Artist is not liable for balloon-related injuries unless caused by direct negligence. Artist carries liability insurance covering direct fault only. No guarantee all guests will be pleased. Denver park clients accept liability for any fines or violations. Note: No helium balloons or arches near zoo by regulation. Shade structures may be added for a fee. Reserved nearby parking must be provided. Client reimburses parking fees. Artist may be late due to traffic or previous gigs; time will be added or refunded. Client must provide water, bathroom, electricity (if needed), and 8x8 space for full shows. Breaks required by Colorado law for 8-hour shifts. Overtime billed at $37.50 per 15 mins. Artist may produce 15–20 deluxe or 40–60 basic balloons/hr. Guest overages may require time/fee increase. Stilt walking clause (if applicable): area must be safe; no guest contact unless invited. Unsafe behavior halts show. Client may assign adult handler. Client assumes full liability for crowd actions and damage. Contract enforceable under U.S. and Colorado law. Applies to client, organization, successors, and agents.
